Terms of Service

These Terms of Service ("Terms") govern your use of NRL Social Centre ("the Platform"), operated by NRL Automations ("we", "us"), Niek Beerens, contactable at niek@nrlautomations.com, including when accessed through a white-label instance operated by one of our agency partners on their own subdomain. By using the Platform, you agree to these Terms.

1. The service

The Platform is a multi-tenant social media analytics dashboard: agencies use it to manage their own clients, and clients use it to view their Instagram, Facebook, ads, and YouTube performance and to reply to their direct messages. Access is granted by invitation from an agency or directly by us; there is no open self-signup. Billing and subscription arrangements are handled outside the Platform, directly between you and the agency or party that invited you (or with us, if you are a direct customer).

2. Accounts and acceptable use

Your account is personal to you; do not share your login credentials. You may not use the Platform to access data you are not authorized to see, attempt to bypass its security or rate limits, reverse-engineer it, or use it for any unlawful purpose. Each workspace's data belongs to that workspace's team; you may only use data available to you through your own role and workspace.

3. Third-party integrations

The Platform integrates with the APIs of Meta Platforms, Inc. (Instagram and Facebook) and Google LLC (YouTube) at your explicit request, when you connect an account. Your use of those connected accounts is also subject to Meta's and Google's own terms of service, in addition to these Terms. The Platform's YouTube features use YouTube API Services: by connecting a YouTube channel you agree to be bound by the YouTube Terms of Service. We are not responsible for outages, API changes, or policy changes made by Meta or Google that affect the Platform's functionality.

4. Data processing

Details on what data we collect, how we use it, and how you can have it deleted are in our Privacy Policy. That policy is part of these Terms.

5. Disclaimer of warranties

The Platform is provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation, and we make no warranty that the Platform will meet every requirement of your business. Analytics and insights shown are as reported by Meta, Google, or other connected providers; we are not responsible for the accuracy of data those providers return to us.

6. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Platform, including lost profits or lost data, except where such loss results from our gross negligence or wilful misconduct.

7. Termination

You or your agency may stop using the Platform, and request account deletion, at any time; see our Data Deletion page for how. We may suspend or terminate access if these Terms are violated, if required by law, or if continued operation of an account poses a security risk to the Platform or other users.

8. Governing law

These Terms are governed by the laws of the Netherlands. Disputes will be submitted to the competent court in the Netherlands, unless mandatory consumer-protection law provides otherwise.

9. Changes to these Terms

We may update these Terms as the Platform evolves. Material changes will be reflected by the "Last updated" date above.

Gebruiksvoorwaarden

Deze gebruiksvoorwaarden ("Voorwaarden") gelden voor je gebruik van NRL Social Centre ("het Platform"), beheerd door NRL Automations ("wij"), Niek Beerens, te bereiken via niek@nrlautomations.com, ook wanneer je het gebruikt via een white-label omgeving van een van onze agency-partners op hun eigen subdomein. Door het Platform te gebruiken ga je akkoord met deze Voorwaarden.

1. De dienst

Het Platform is een multi-tenant social-media-analyticsdashboard: agencies gebruiken het om hun eigen klanten te beheren, en klanten gebruiken het om hun Instagram-, Facebook-, advertentie- en YouTube-prestaties te bekijken en hun directe berichten te beantwoorden. Toegang wordt verleend via uitnodiging door een agency of rechtstreeks door ons; er is geen open zelfregistratie. Facturatie en abonnementsafspraken worden buiten het Platform geregeld, rechtstreeks tussen jou en de agency of partij die je heeft uitgenodigd (of met ons, als je een directe klant bent).

2. Account en acceptabel gebruik

Je account is persoonlijk; deel je inloggegevens niet. Je mag het Platform niet gebruiken om toegang te krijgen tot gegevens waarvoor je geen bevoegdheid hebt, de beveiliging of gebruikslimieten te omzeilen, het te reverse-engineeren, of het voor onwettige doeleinden te gebruiken. De gegevens van elke werkruimte horen bij het team van die werkruimte; je mag alleen gegevens gebruiken die voor jou beschikbaar zijn via je eigen rol en werkruimte.

3. Koppelingen met derden

Het Platform koppelt, op jouw expliciete verzoek zodra je een account koppelt, met de API's van Meta Platforms, Inc. (Instagram en Facebook) en Google LLC (YouTube). Je gebruik van die gekoppelde accounts valt naast deze Voorwaarden ook onder de eigen gebruiksvoorwaarden van Meta en Google. De YouTube-functies van het Platform gebruiken YouTube API Services: door een YouTube-kanaal te koppelen ga je ook akkoord met de Servicevoorwaarden van YouTube. Wij zijn niet verantwoordelijk voor uitval, API-wijzigingen of beleidswijzigingen van Meta of Google die de werking van het Platform beïnvloeden.

4. Gegevensverwerking

Details over welke gegevens we verzamelen, hoe we ze gebruiken, en hoe je ze kunt laten verwijderen staan in onze Privacyverklaring. Die verklaring maakt onderdeel uit van deze Voorwaarden.

5. Uitsluiting van garanties

Het Platform wordt geleverd "as is" en "as available". We garanderen geen ononderbroken of foutloze werking, en geven geen garantie dat het Platform aan elke eis van jouw bedrijf voldoet. Getoonde analyses en inzichten zijn zoals gerapporteerd door Meta, Google of andere gekoppelde providers; we zijn niet verantwoordelijk voor de juistheid van gegevens die deze partijen aan ons teruggeven.

6. Beperking van aansprakelijkheid

Voor zover wettelijk toegestaan zijn we niet aansprakelijk voor indirecte, incidentele of gevolgschade die voortvloeit uit je gebruik van het Platform, waaronder gederfde winst of verloren gegevens, behalve wanneer die schade het gevolg is van grove nalatigheid of opzet onzerzijds.

7. Beëindiging

Jij of je agency kunnen op elk moment stoppen met het gebruik van het Platform en accountverwijdering aanvragen; zie onze pagina over gegevensverwijdering voor hoe. We kunnen toegang opschorten of beëindigen bij schending van deze Voorwaarden, indien wettelijk vereist, of als een account een beveiligingsrisico vormt voor het Platform of andere gebruikers.

8. Toepasselijk recht

Op deze Voorwaarden is Nederlands recht van toepassing. Geschillen worden voorgelegd aan de bevoegde rechter in Nederland, tenzij dwingend consumentenrecht anders bepaalt.

9. Wijzigingen in deze Voorwaarden

We kunnen deze Voorwaarden bijwerken naarmate het Platform zich ontwikkelt. Wezenlijke wijzigingen zijn te zien aan de datum "Laatst bijgewerkt" bovenaan.
